Tax Law: Ina Reese in Flensburg and Harrislee

Tax Law & Criminal Tax Law: Planning and defence under one roof

Legal support that complies with the law on tax matters, during tax audits and in criminal tax proceedings

As a solicitor and specialist in tax law, Ina Reese combines tax planning advice with the assertiveness expected of a solicitor. She assists private individuals, self-employed professionals and small and medium-sized enterprises in Flensburg and the surrounding area, from day-to-day tax planning through to defence in criminal tax proceedings.

Tax planning rather than merely complying with obligations

Tax law often only becomes an issue when a deadline is approaching or a tax assessment notice arrives in the post. It makes more sense to take the opposite approach: to make tax decisions in such a way that future disputes are prevented from arising in the first place. This includes choosing the appropriate form of taxation, assessing the scope for structuring investments or reorganisations, and forward-looking planning for asset transfers. Ina Reese brings together two perspectives: tax assessment as a specialist solicitor in tax law and legal protection as a solicitor – an advantage that pays off particularly in more complex cases, where purely specialist advice reaches its limits.

Tax Law & Criminal Tax Law

Representation during tax audits, appeals and legal proceedings before the tax court

A tax audit or a tax assessment that differs from expectations is no cause for concern, but it is certainly a reason to adopt a clear strategy. Ina Reese supports clients throughout tax audits, from the initial notification right through to the final meeting, checks tax assessments for errors and conducts appeal proceedings against the tax office. If a dispute cannot be resolved at this stage, as a solicitor she also handles the legal proceedings and represents clients before the tax court – a step for which a tax adviser without a solicitor’s licence would have to refer the matter to an external solicitor. At Reese Law Firm, responsibility remains in a single set of hands throughout the process.

Criminal tax proceedings: Defence from the tax investigation stage through to the trial

Clients are often caught off guard by allegations of tax evasion, triggered by a tax audit, a notice of investigation or a report by a third party. It often begins with a visit from the tax investigation authorities, accompanied by a search of residential or business premises and the seizure of documents and data storage media. In this situation, one thing matters above all else: acting swiftly and judiciously before ill-considered statements complicate the defence. Ina Reese represents clients throughout the entire criminal tax proceedings, from the tax investigation department’s initial actions, through the preliminary investigation involving the Crown Prosecution Service and the tax authorities, right up to the main hearing in court. Because she is able to assess the tax aspects of the case herself, there is no need for the coordination between a tax adviser and a criminal defence lawyer that would otherwise be required – a time-saving advantage that is often crucial in pre-trial investigations.

Voluntary disclosure: a legally sound return to tax compliance

Anyone wishing to disclose untaxed income retrospectively may do so without facing penalties, subject to certain conditions; however, the requirements for a valid voluntary disclosure are strict and leave no room for rectification. If even a single piece of information is missing or the declaration is submitted too late, immunity from prosecution is completely forfeited. Ina Reese will assess in advance whether and in what form a voluntary disclosure is feasible, work with you to determine the full taxable income, and draft the disclosure in such a way that it meets the legal requirements.

The advantage of having two qualifications

It is rare to find a lawyer who is also a specialist in tax law, and in practice this makes a noticeable difference. A tax adviser who is not admitted to the bar may not act as a defence counsel in criminal tax proceedings. A solicitor without in-depth tax knowledge must first familiarise themselves with complex tax matters or rely on external expert opinions. As a specialist in tax law, Ina Reese covers both aspects: the technical assessment of the tax situation and its legal enforcement, within a single, integrated mandate, without any loss of efficiency at the interface.

Tax issues relating to business decisions

Whether it is the formation of a company, the choice of legal form, a change in shareholders or business succession, business decisions almost always have a tax dimension that should be taken into account at an early stage. Ina Reese advises on the tax implications of individual structuring options and coordinates closely with the corporate law team. Information on the legal implementation of company formation, articles of association and succession planning can be found on the [Company Law] page; tax law and company law are dealt with in an integrated manner where necessary.

Tax planning and legal defence are based on different principles, yet in practice they are rarely used separately. Reese offers both under one roof: forward-looking advice when there is time for planning, and resolute representation when more is at stake than just a figure on a tax assessment notice.
